Port Moody Bicycle Accident Lawyers

Throughout Port Moody, community members of all ages love to explore the scenic landscape on their bikes. Biking is a popular recreational activity that can be enjoyed alone, with friends, or with family members. Unfortunately, riding a bicycle in Port Moody can be dangerous, especially for those cyclists who encounter negligent drivers on the road.

Although drivers are required to abide by the rules mandated within the province’s Motor Vehicle Act and fulfill a duty of care to all other road-users, many local motorists fail to live up to their responsibilities. When drivers engage in negligent actions (or inactions) on the road, the lives of innocent cyclists can be put at risk. Bike riders who are struck by negligent drivers can suffer wrongful deaths or sustain permanent, life-changing injuries.

On May 1, 2021, ICBC implemented a new “enhanced care” insurance model. ICBC is the province’s sole provider of basic automobile insurance, and is owned by the provincial government. Under this newly imposed insurance system, anyone who has been injured in a motor vehicle collision should be able to collect no-fault accident benefits to offset the costs of their injury-related financial losses. Even negligent drivers whose own wrongful behaviour behind the wheel caused a collision in which a cyclist was severely injured could be entitled to no-fault accident benefits if they sustain injuries in the crash.

However, by implementing this new “enhanced care model,” ICBC has unilaterally taken rights away from injured accident victims. Injured cyclists are no longer able to sue the at-fault driver whose negligence caused their crash. On top of that, if a bicycle accident victim’s ICBC claim is denied or the settlement they are awarded is insufficient to cover their total injury-related losses, they will have limited options to appeal the insurance company’s determination.

ICBC’s new “enhanced care” insurance model has already had adverse outcomes for the most vulnerable road-users who have been injured in collisions across the province. To express your concerns over this unfair new system of providing support to injured accident victims, contact your MLA.

If you were injured in a collision caused by a negligent motor vehicle operator before May 1, 2021, you might be entitled to pursue a civil claim against the negligent driver. By working with our Port Moody bicycle accident lawyers, eligible cyclists may be able to recover damages they have incurred– or will incur in the future– as a result of their injury-causing collision.
