Successful Summary Trial Application Beats Attempted Claim Dismissal

Joseph Fearon was recently successful against Aviva’s attempt to dismiss his client’s claim by way of summary trial application.  

Summary trial applications require many hours of preparation and considerable effort from all members of the litigation team. The stakes are also high since a loss means the client will receive no compensation. Indeed, a loss could put clients further into debt, as they might be found responsible for paying the insurance company’s legal costs.
